Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to face human smuggling charges, he was detained in federal detention.
In her order, the judge noted that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court challenge center on conflicting assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
